These Terms of Sale and Returns govern the rights and obligations arising between the Online Store and the purchaser in connection with the purchase of goods through the Online Store.
The owner of the Online Store is Fookuses Fitness OÜ (registry code 17382773, hereinafter referred to as the Online Store).

Validity of the Sales Agreement, Product and Pricing Information
These Terms of Sale apply to all goods purchased from the Online Store.
The prices of the products sold in the Online Store are displayed alongside the respective products. All prices are stated in euros and are subject to the applicable delivery fee.
The delivery fee depends on the purchaser’s location and the selected delivery method and is displayed during the checkout process.
Information about each product is provided on its respective product page in the Online Store.
Placing an Order
To place an order, add the desired products to your shopping cart, complete the required information, and select your preferred delivery method. The total amount payable will then be displayed, which can be paid securely using the following payment methods:
- Bank card (Visa, Mastercard and American Express)
- Apple Pay and Google Pay
- Online bank transfer (Swedbank, SEB, Luminor, Citadele, LHV, Coop Pank, Artea, Revolut and N26)
- Inbank payment solutions:
- Installment payments (from €100)
- Pay in 3 instalments (from €75)
- Pay next month (from €30)
Important! When paying by online bank transfer, please make sure to click the “Return to Merchant” button on your bank's website after completing the payment.
Payments are processed by Maksekeskus AS. When paying by online bank transfer, the payment is processed in the secure environment of the respective bank. Card payments and other payment methods are processed in the secure payment environment of Maksekeskus AS. The seller does not have access to the customer's bank or card details.
The sales agreement enters into force once the amount payable has been received in the Online Store's bank account.
By placing an order, the purchaser confirms that they have read and agree to these Terms of Sale and Returns.
The owner of the Online Store is the controller of the purchaser's personal data and transfers the personal data necessary for processing payments to the authorised processor, Maksekeskus AS.
If the ordered goods cannot be delivered due to being out of stock or for any other reason, the purchaser will be informed as soon as possible. Any amounts paid, including the delivery fee, will be refunded without undue delay, but no later than 14 days from the date the purchaser is notified.
Delivery
We currently deliver orders to the following countries: Estonia, Finland, Latvia, Lithuania, Poland, Germany, the Netherlands, Luxembourg, Ireland, Denmark, Austria, Spain, Portugal, Italy, Croatia, Slovenia, Greece, Bulgaria, Slovakia, the Czech Republic and Hungary.

The following delivery methods are available:
- DPD parcel locker
- Smartpost parcel locker
- Omniva parcel locker
- Unisend parcel locker
The purchaser is responsible for the delivery costs. The applicable delivery fee is displayed during the checkout process.
Orders within Estonia are generally delivered to the purchaser's selected destination within 2–7 business days from the date the sales agreement enters into force. Deliveries outside Estonia are generally completed within 21 calendar days.
In exceptional circumstances, the Online Store reserves the right to deliver the goods within up to 45 calendar days.
Right of Withdrawal
After receiving the order, the purchaser has the right to withdraw from the contract concluded through the Online Store within 14 days.
The right of withdrawal does not apply where the purchaser is a legal entity.
To exercise the 14-day right of withdrawal, the ordered goods may only be used to the extent necessary to establish their nature, characteristics and functioning, in the same way as would be permitted when examining the goods in a physical store.
If the goods have been used for any purpose other than that described above or show signs of use or wear, the Online Store has the right to reduce the amount to be refunded in accordance with the decrease in the value of the goods.
To return the goods, the purchaser must submit a withdrawal notice. The withdrawal notice may be submitted using the Withdrawal Form or by sending it electronically to fitness@fookuses.com no later than 14 days after receiving the goods. If the notice is submitted in free form, it must include at least the order number and the purchaser's first and last name.
The Online Store will bear the cost of returning the goods if the reason for the return is that the returned product does not correspond to the order (for example, an incorrect or defective product).
The purchaser must return the goods within 14 days of submitting the withdrawal notice or provide proof that the goods have been handed over to the carrier within that period.
The Online Store will refund all payments received under the sales agreement without undue delay, but no later than 14 days from the receipt of the withdrawal notice. The Online Store may withhold the refund until the returned goods have been received or until the purchaser has provided proof that the goods have been returned, whichever occurs first.
If the purchaser has expressly chosen a delivery method other than the least expensive standard delivery method offered by the Online Store, the Online Store is not required to reimburse the additional costs exceeding the cost of the standard delivery method.
The Online Store reserves the right to withdraw from the sales agreement and require the purchaser to return the goods if the price of the goods has been displayed in the Online Store significantly below their actual market price due to an error.
Right to Submit a Claim
The Online Store is liable for any non-conformity or defect in the goods sold to the purchaser that existed at the time of delivery and becomes apparent within two years from the date the goods were delivered to the purchaser.
If a defect becomes apparent within the first year after the goods have been delivered, it is presumed to have existed at the time of delivery unless such presumption is incompatible with the nature of the goods or the defect. The burden of proving otherwise rests with the Online Store.
If a defect is discovered, the purchaser has the right to contact the Online Store no later than two months after becoming aware of the defect by sending an email to fitness@fookuses.com.
The Online Store is not liable for defects that have arisen after the goods have been delivered to the purchaser.
If the goods purchased from the Online Store have a defect for which the Online Store is liable, the Online Store will repair or replace the defective goods. If repair or replacement is not possible, the Online Store will refund all amounts paid by the purchaser under the sales agreement.
The Online Store will respond to the consumer's complaint in writing or in a format that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store processes the purchaser's personal data for the purpose of processing orders, delivering goods and fulfilling obligations arising from the sales agreement.
The Online Store sends newsletters and promotional offers only where the purchaser has given prior consent. The purchaser may withdraw this consent at any time by using the unsubscribe link included in the newsletter or by contacting the Online Store.

Dispute Resolution
If the purchaser has any complaints regarding the Online Store or the goods purchased, they should be submitted by email to fitness@fookuses.com.
If the purchaser and the Online Store are unable to resolve a dispute by agreement, the purchaser has the right to refer the matter to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between the purchaser and the Online Store. The review of a complaint by the Committee is free of charge for the purchaser.
